Defense For Medical Marijuana Patients Accused Of MMMA Violations

Contextual Image

Many patients in Michigan rely on medical marijuana to manage debilitating or painful medical conditions. Those who are approved and registered to use, possess and grow medical marijuana, however, must do so under the guidelines of the Michigan Medical Marijuana Act (MMMA). If a patient violates the MMMA — knowingly or not — he or she may face serious criminal charges.

Since the MMMA was passed by Michigan voters in 2008, criminal defense attorney Michael A. McInerney has dedicated a major portion of his practice to defending individuals and businesses that are accused of violating medical marijuana laws.

Understanding The Michigan Medical Marijuana Act

The MMMA has very specific rules about how a patient can access and possess medical marijuana, including:

  • A patient can have no more than 2.5 ounces of usable marijuana.
  • A patient can have no more than 12 marijuana plants.
  • Marijuana plants must be in an enclosed and locked facility that only the patient has access to.

Many people do not realize the severe consequences of violating the MMMA. However, if you violate it, you will be treated as an alleged drug offender who was never registered to use medical marijuana. For example, if you have 13 marijuana plants, you will not be charged with having one more plant than you are allowed to. Instead, you will be charged as illegally having 13 marijuana plants without a medical marijuana registration.

Defending Your Rights

Just because you are charged with violating the MMMA does not mean you will be convicted or will go to jail or prison. We have more than 30 years of criminal defense experience. Lawyer Michael A. McInerney will carefully review your case to determine whether police or others violated your rights when uncovering evidence against you.
